1. DEFINITIONS

“Music,” “Tracks,” or “Content” — Any audio files made available through the Service, including AI-generated music.

“Royalty-Free License” — A usage license granting permission to use tracks without paying ongoing royalties, subject to these Terms.

“Subscriber” — Any user with an active paid subscription.

“User” / “You” — Anyone accessing or using the Service, with or without an account.

“Exclusive License” — A premium purchase where a specific track is removed from the library and licensed exclusively to one buyer.

2. ACCEPTANCE OF TERMS

By creating an account, submitting a form, downloading content, or using the Service, you acknowledge that you:

  • Have read and understand these Terms
  • Agree to be legally bound
  • Are at least 18 years old or have legal authorization to use the Service
  • Agree to receive email communications as outlined in Section 16

3. LICENSE GRANT

With an active subscription, Neural Noises grants you a non-exclusive, non-transferable, Royalty-Free License to use downloaded tracks in:

  • YouTube videos & monetized channels
  • TikTok, Instagram, Facebook & social media
  • Twitch livestreams & VODs
  • Podcasts & audiobooks
  • Client projects
  • Online courses
  • Films, trailers, animations & documentaries
  • Games, apps, and software
  • Commercial videos & advertisements
  • Websites & background media

You may use tracks forever in any project created during your active subscription.

4. LICENSE RESTRICTIONS

You may not:

  • Resell, re-upload, or redistribute raw audio files
  • Upload music to streaming platforms (Spotify, Apple Music, etc.)
  • Claim authorship or ownership
  • Create a competing music or sound library
  • Train AI models with our audio
  • Resell, rent, lend, or sublicense the music
  • Use music in illegal, harmful, or defamatory content
  • Use tracks to create stock audio for resale

You may not significantly alter the music to create a new standalone audio work for redistribution or resale.

5. SUBSCRIPTION & BILLING

  • Subscriptions renew automatically unless canceled
  • Cancel anytime; access continues through billing period
  • No refunds for partial billing periods or unused time
  • Prices may change with notice
  • Failed payments may result in paused or terminated access

After cancellation:

  • You may continue using music in existing projects
  • You may not create new projects without an active subscription

6. EXCLUSIVE LICENSES (If Offered)

  • Track is removed from public library
  • Buyer receives exclusive usage rights and ownership of the composition
  • Non-refundable
  • Neural Noises may archive privately

7. INTELLECTUAL PROPERTY

All music, branding, content, and materials remain property of NeuralNoises.com unless otherwise stated.
You are granted a license, not ownership.

8. COPYRIGHT & DMCA POLICY

We comply with the Digital Millennium Copyright Act (DMCA).

  • We do not register our music with Content ID systems
  • If you receive a copyright claim:
    • Contact support
    • Provide proof of license
    • We will assist in resolving it

Fraudulent DMCA claims may result in termination.

9. PROHIBITED ACTIONS

You may not:

  • Attempt to hack or disrupt the Service
  • Share your account
  • Use bots or automation to download content
  • Reverse engineer the platform
  • Use music in political campaigns

10. ACCOUNT TERMINATION

We may terminate accounts for:

  • Fraud or abuse
  • Violating these Terms
  • Chargebacks or disputes
  • Unauthorized use after cancellation

Access to downloads ends immediately upon termination.

11. DISCLAIMERS

Service is provided “as is” and “as available.”
We do not guarantee:

  • No interruptions
  • Perfect performance
  • Continuous availability

Use at your own risk.

12. LIMITATION OF LIABILITY

To the fullest extent allowed by law:

  • We are not liable for indirect or consequential damages
  • Liability is limited to the amount paid in the last month
  • We are not responsible for third-party platforms

13. CHANGES TO TERMS

We may update these Terms at any time. Continued use = acceptance.
